US: Ban Expires on Entry of Certain Nonimmigrants

The temporary ban on entry for workers with H-1B, H-2B, J and L nonimmigrant visas under Presidential Proclamation 10052 has expired. Applicants whose visas were denied during the ban must submit a new application, including a new fee.

Nonimmigrant visa applicants still waiting to be interviewed or scheduled for an interview will have their applications prioritized as more State Department workers return to their facilities. The State Department is continually providing operational updates for visa services around the globe. Emergency and mission-critical visa services are still being offered.

In addition, the State Department has extended the interview waiver eligibility period that applies to visa renewals under the same classification. Applicants whose nonimmigrant visa expires within 48 months are now eligible for the waiver. This extension, effective through December 31, 2021, will allow those seeking certain nonimmigrant visas the opportunity to secure a visa without appearing at a consular section.

Takeaway: For companies retaining workers under the visa regulations, an informed view into the process can go a long way toward avoiding issues that could deny access to desired workers or cost them the continued services of a current worker. A proactive approach to navigating the visa status of current and potential workers involves the hiring company, the suppliers and the workforce solutions partner. A coordinated strategy and review of processes can help ensure alignment and predictable outcomes for everyone involved.
