India: Companies Advised to Build Comprehensive Work-From-Home Policies

The government issued an advisory that urges companies to build long-term work-from-home (WFH) policies for jobs where remote work is possible. The union labor secretary said that many employers were already exploring WFH options as a long-term solution to mitigate COVID-19 and supplement current work arrangements.

Comprehensive WFH policies directed by both worker and employer representatives will help maintain India’s commitment to promoting workers’ rights, encouraging better employment opportunities and enhancing social protections. Differentiated WFH policies are also being considered for flexible workers with an emphasis on ensuring support for any new workers’ rights developments as they may arise.

As part of the advisory, the Ministry of Labour recommended that state governments allow WFH accommodations for nursing mothers. The advisory encourages employers to allow nursing mothers to work remotely wherever the nature of the work permits for at least one year from the date of birth of the child.

India is also starting to see a return to the office under certain conditions. The Government of Karnataka is now allowing the operation of commercial establishments as long as employers are following all appropriate COVID-19 protocols. Employers must also ensure that only employees who are vaccinated have access to office premises.
