Companies in the U.S. Struggle with Sick Leave Regulations

Employers are growing anxious concerning the blossoming array of state and local regulations regarding sick leave. According to a recent survey by Littler Mendelson, P.C., 69 percent of companies reported compliance challenges due to state and local laws on sick leave. Often, these laws create even further challenges as companies reconcile their demands against those of the Family and Medical Leave Act.

Takeaway: A number of potentially conflicting laws for paid sick leave are proliferating at the state level across the United States. For companies operating across multiple states or jurisdictions, arriving at a common sick leave and PTO policy may not be possible under current conditions. Examples of variation include different “front loading” versus accrual of sick leave, definitions of sick leave, or conflicting rules about prorating such accumulations of leave.
